Donald Trump drops lawsuit against New York Attorney General Letitia James

Less than a day after receiving a warning from a federal judge, former President Donald Trump withdrew his lawsuit against New York Attorney General Letitia James.

The withdrawal came in a brief document filed Friday morning with U.S. District Judge Donald Middlebrooks, who on Thursday warned Trump’s legal team that the lawsuit seemed almost frivolous.

“Plaintiff, PRESIDENT DONALD J. TRUMP, by and through his undersigned attorney and pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), voluntarily dismisses your claims in this action against the Defendant, LETITIA JAMES, without prejudice,” the letter read.

Trump’s lawsuit against AG sought to protect Trump’s revocable trust from James, who has an ongoing $250 million civil suit alleging fraudulent conduct at the Trump Organization. James accused Trump and his family of “grossly” inflating the former president’s net worth by billions of dollars and misleading creditors and others with false and misleading financial statements.

Trump, who has denied the allegations, called the investigation of James, who is black, a politically motivated “witch hunt” by an attorney general he called “racist”.

Trump’s lawsuit against James accused her of “intimidation and harassment” and of making repeated “attempts to steal, destroy or control all of Trump’s stuff”.

On Thursday, Middlebrooks ordered Trump and his attorney Alina Habba to pay fines of nearly $1 million after ruling that Trump’s 2022 lawsuit against Hillary Clinton was frivolous litigation intended only to “seek revenge.”

Trump sued Clinton in March 2022, for allegedly “acting in concert” with FBI leadership to concoct what became known as the Russia investigation into 2016 election interference. Trump argued that the Russia investigation was “prolonged and exacerbated by the presence of a small faction of Clinton supporters who were well positioned in the Justice Department”. Middlebrooks rejected the suit last September.

In his Thursday ruling, the judge also warned Trump’s lawyers that they could face sanctions over the lawsuit against James.

In the opinion, Middlebrooks called Trump “a prolific and sophisticated litigator who repeatedly uses the courts to exact revenge on political opponents.”

“He is the mastermind of the strategic abuse of the judicial process and cannot be seen as a litigator blindly following the advice of an attorney. He was well aware of the impact of his actions,” Middlebrooks wrote.

Habba did not immediately return a request for comment from ABC News.
